THE MALAYSIAN SOCIETY OF PHARMACEUTICAL TECHNOLOGY (MSPT)

TERMS & CONDITIONS

1.    Introduction

1.1. The Malaysian Society of Pharmaceutical Technology (MSPT) is a non-profit, professional society with the registration number of PPM-030-07-26122001 and registered address is at the Discipline of Pharmaceutical Technology, School of Pharmaceutical Sciences, Universiti Sains Malaysia, 11800 USM, Penang, Malaysia (individually or collectively, “Society”, “we”, “us” and “our”).

1.2. These are the registration terms and conditions subject to which we will allow you to register (whether as an individual, firm or company) as a member (individually or collectively, “you”, “your”, “member”) of the MSPT.

1.3. The MSPT is intended for individual, academic, professional, or business audiences. You must read and accept all of the terms and conditions in the Terms & Conditions, and you must consent to the processing of your personal data as described in the Privacy Policy linked hereto.

1.4. These Terms & Conditions are made only in the English language,

2.    User Guidelines

2.1. Membership

2.1.1. The membership of the Society is open to all Malaysian citizens over the age of 18 years and residing in Malaysia. The Society offers different types of membership as listed below:

2.1.2. New application for MSPT membership requires an additional RM 10 (USD 2) for registration purpose.

2.1.3. All membership is from 1st January till 31st December for each year, irrespective of the date you join or renew.

2.2 Payment Method

2.2.1  Payment can be made via online banking / bank transfer / credit card.

2.2.3  Registration payment via credit card can be made using this link: https://www.billplz.com/msptmembership

2.2.4  Payment of any bank transfer charges and any extra charges related to the bank transfer transaction is your responsibility.

2.2.5  Save the proof of payment and upload it in the Online Registration Form or send it together with your complete Registration Form.

2.2.6  All sums payable by you under this Agreement are subject to any applicable tax, levy or similar governmental charge, including value added or sales tax which we shall add at the applicable rate.

2.2.7  All sums due under this Agreement shall be paid in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).

2.3 Confirmation Process

2.3.1 Once you complete your Registration Form, please check the details and order carefully before confirming and submitting it if you do it online, or before mailing it to us. After we receive your complete registration form, we will process your registration immediately. Your registration is not confirmed until you receive an email confirmation from us which sets your registration details and other useful information.

2.3.2  If you do not receive our email confirmation within 24 hours of you submitting your online registration form or within 30 days of you mailing your registration form, please contact us at mspt@usm.myas soon as possible. It is your responsibility to update us of any changes to your contact details so that we are able to contact you.

2.4 Member Benefits

2.4.1 A member is eligible for a reduced registration fee to MSPT events.

2.4.2  A member can apply for the MSPT Award and Travel Grant program. Priority will be given to postgraduate students who have never received the award and also for oral presentation delivered at the international level. Nevertheless, the award is open to all Members who are selected for either poster or oral presentation.

3.    Registration Cancellation and Refund Policy

3.1  If you wish to cancel your membership, you must email us at mspt@usm.my as soon as possible as this will impact on whether we can give you a refund of your registration fees.

3.2  A cancellation fee of RM10 applies for cancellations received on or prior to 31st March of the year. From 1st April to 30th June of the year, your cancellation charge will be 50% of your paid registration fee. After this date, any membership cancellation is not eligible for a refund.

3.3  It may take up to 4 weeks to receive any refunds.

4.    Data Protection

4.1  To the extent that you provide us with Personal Data under this Agreement, we shall process such Personal Data as an independent Data Controller and in accordance with our Privacy Policy.

4.2  Where you provide us with Personal Data of third parties, you warrant, represent and undertake that you have complied with all applicable Data Protection Legislation in respect of such Personal Data, including obtaining all permissions, consents and approvals of Data Subjects to provide their respective Personal Data to us.

5.    Privacy Policy

5.1  Using links to external sites. Please remember that when you use a link to go from our website to another website, our Privacy Notice no longer applies. Your browsing and interaction on any other website or your dealings with any other third party service provider, is subject to that website’s or third party service provider’s own rules and notices/policies. We do not monitor, control, or endorse the information collection or privacy practices of any third parties. This Notice applies solely to information collected by us through our website or services and does not apply to these third party websites and third party service providers.

5.2  Collection of your personal data. We collect personal data from you when you register to our organisation. The information we routinely collect will include your contact details (e.g. name, email address, phone number and postal address). We will also collect specific information when you register to attend our activity (e.g., conference, webinar). We may also collect details about your dietary and accessibility requirements. We only collect this information with your explicit consent and will only use it for the purposes of your attendance at the event.

5.3  How we use your personal data for the conference event. The Society serves as a platform for members and other experts in the field, academic and industry, to meet, learn and discuss the latest topics and trends in pharmaceutical technology field. We will share your details (name, job title and company name ONLY) with event sponsors and speakers, to help them prepare for networking opportunities and to ensure that any content and activity on the day is tailored specifically to the audience attending. This information is not used for sales and marketing communications. Please email us if you would prefer us not to share your details in this way.

5.4  Sharing your personal data for payment, audit & verification, and legal disclosure.

5.4.1  Payment. When you are required to pay for one of our products or services, we will share some of your personal details with BillPlz Sdn Bhd and Paydee Sdn Bhd. This information will include the cardholder’s name, bank account details and payment card details, and will be used to process the payment transaction on our behalf. BillPlz and Paydee will also use this information themselves for the purposes of monitoring, preventing and detecting of fraudulent payment transactions; comply with legal or regulatory obligations applicable to the financial sector; and to develop, analyse and improve the service.

5.4.2  Audit & Verification. We may share your personal data with the auditing organisation. This is only so the auditor can verify aggregated statistics about circulation and usage of our products or review our policies, processes and procedures for compliance with relevant standards.

5.4.3  Legal disclosure. We may need to disclose your personal data to comply with any legal obligation. These requests will be verified before we consider sharing your details.

5.4.4  Changes to our organisation. In the event we go through a organisation transition, your personal data may be among the assets transferred.

5.5  Social Media

5.5.1  Using social media sign-in. On some of our websites we enable you to sign in using your social media account like Google, Twitter or Facebook. We will inform you if we wish to access more than just basic account information during this process, so you can let us know you are happy to share these details with us. We recommend you also check what permissions you enable in your social media profiles.

5.5.2  Social media share widgets. We use social media widgets allowing you, for example, to ‘Like’ or ‘Tweet’ a particular piece of content on our websites. We use different social media platforms to help us do this, including Facebook, LinkedIn and Twitter. When social media share widgets are used on our websites, limited technical information is shared with the social media platform. This will include any cookie or device identifiers, IP addresses, the type of device, the browser and operating system. For more information, please read the ‘Information from Partners’ section on Facebook’s privacy notice, the ‘Posts, Likes, Follows, Comments, Messages’ section on LinkedIn’s privacy notice and the ‘Information we receive from third parties’ section on Twitter’s privacy notice.

5.6  Your rights.

5.6.1  Access your personal data. You can request a copy of the personal data we may hold relating to you, and the purposes for which we are using it. In responding to such a request, we may ask for proof of your identity, to ensure we do not inadvertently send your personal data to another person. We will endeavour to respond to any such requests as soon as possible, but at least within one calendar month. Please contact us using provided contact details.

5.6.2  Amend your personal data. If you discover or believe the personal data, we hold for you is out-dated or incorrect, please let us know and we will rectify this as soon as possible and make necessary changes based on your request. Please contact us using provided contact details.

5.6.3  Delete your personal data. If you wish your personal data to be deleted, we will evaluate such request on a case-by-case basis. We will respond to you as soon as possible, at least within one calendar month of receiving your request.

If we have disclosed your personal data (e.g. your CV) to another organisation before you sent us your request, we will contact each organisation and inform them of your request, unless this proves impossible or involves disproportionate effort. You can request a list of organisations who we have shared your details with.

5.7  Keeping your data secure.

5.7.1  Where we store and process your personal data. Ensuring your personal data is kept and transferred securely is of the highest importance to us. We store your personal data on our secure systems.

5.7.2  How we keep your personal data secure. We are committed to protecting the security of the personal data we hold. We deploy appropriate technical and organisational measures to ensure your personal data is kept securely and to prevent any unauthorised access. We have robust procedures and features in place to prevent such unauthorised access. We also require any parties to whom we transfer personal data to ensure they have appropriate security measures in place.

5.7.3  How long do we keep your personal data. We will only keep your personal data for a reasonable period of time and we base this on the purpose for which we are using it. There will be circumstances in which we keep a strictly minimal amount of information about you, for example to ensure we can honour an objection to receiving direct marketing. We will also, in specific circumstances, be required to retain personal data for a longer period of time for contractual or legal reasons. We have a detailed internal schedule for ensuring we do not hold your personal data for longer than we justifiably need it

5.8  Reporting security vulnerabilities. We are committed to the privacy, safety and security of our customers. If you discover a potential security vulnerability, we would ask you to please report it just to us in a responsible manner. Please email us at mspt@usm.my and we will respond to you as soon as possible. This provides us with an opportunity to work with you and quickly address and resolve any issue. Publicly disclosing a potential vulnerability could put the wider community at risk, and therefore we encourage you to come to us first. We’ll keep you informed as we move forward with our investigations.

6.    Copyright and Intellectual Property

6.1  Any and/or all IP in the Society, including its activity, shall be our sole and exclusive property (or the appropriate third-party owner(s), if any) and you shall not acquire any rights in such materials, including any developments or variations of them. This Agreement does not grant you any IP rights in any materials from the Society and its activity. You agree not to reproduce, sell, and/or copy (in whole or in part) the material, except for purposes of post-activity references. 7.    Liability

7.1  Nothing in this Agreement is intended to limit or exclude our liability for (a) death or personal injury caused by our negligence, and (b) fraud or fraudulent misrepresentation.

7.2  You shall not exclude or limit your liability under any indemnities given by you under this Agreement.

7.3  You shall fully and effectively indemnify and hold harmless us and any Group Company against all losses, actions, costs (including legal fees and disbursements on a solicitor/client basis), claims, demands, fines, damages and liabilities, of whatever nature, incurred or suffered by or made against us, whether or not foreseeable, arising directly or indirectly, wholly or in part, out of or in connection with any breach of this Agreement by you.

7.3.1  Group company means an entity that directly or indirectly controls, is controlled by, or is under common control with a party. “Control” shall mean the power, direct or indirect, to direct or cause the direction of the management and policies of an entity whether by contract, ownership of shares, membership on the board of directors, agreement or otherwise.

7.4  We shall not (whether in contract, tort, negligence, statutory duty or otherwise) be liable to you under this Agreement for consequential, indirect or special damages (including indirect loss of profit and indirect loss of revenue).

7.5  Subject to the clauses above, our maximum aggregate liability to you under this Agreement (whether arising in contract, tort, negligence, statutory duty or otherwise) shall not exceed the registration fees you paid to us.

8.    Governing Law and Jurisdiction.

8.1  This Agreement and any dispute or claim arising out of or in connection with it whether in contract, tort (including negligence), breach of statutory duty or otherwise shall be governed by, and construed in accordance with, the laws of Malaysia, and shall be subject to the exclusive jurisdiction of the Malaysia courts.
